(A) Dance Hall. A public establishment, located outside the corporate limits of any city, village or incorporated town in Union County, Illinois, that for an admission fee, provides music and space for dancing, and may also provide refreshments (other than alcohol) and dancing partners, for the purposes of dancing, entertainment, and socialization.
(B) Road House. A tavern, night club, or similar establishment located beyond the corporate limits of any city, village or incorporated town in Union County, Illinois, on or near a public roadway not otherwise governed by the Union County Liquor Control Code.
(C) Topless. Wearing transparent clothing or material or being naked or substantially without clothing covering the breast area of the body.
(D) Bottomless. Wearing transparent clothing or material or being naked or substantially without clothing or covering of the body from the waist downward to a point of the body that would cover the genital area of the body.
(E) Proper Adult Escort. An adult age twenty-one (21) or over granted supervisory authority by the parents or leal guardian of a youth or youths under the ages outlined herein who is wholly and solely responsible for the actions or inactions of the person or persons over whom they are given authority.
7-2-2 LICENSE. TheCountyBoard may upon application, pursuant to statute, grant such license to operate or maintain a dance hall or road house.
7-2-3 LICENSE FEE. The license fee shall be Twenty-Five Dollars ($25.00) deposited in the County General Fund.
7-2-4 LICENSE APPLICATION. Attached hereto and included as part of this Code is an application form which shall be used by those who apply for a dance hall or road house license in Union County.
7-2-5 LICENSE APPROVAL PROCEDURE. Upon receipt of the completed license application and license fee by the Union County Clerk and Recorder, the Chairman of the County Board shall make a thorough investigation to determine the fitness of the applicant and the truth of the statements made and accompanying the application and report to the County Board on the findings made. The County Board shall then vote on accepting the application and granting the license within thirty (30) days of receipt of the application and fee with a majority vote granting acceptance and issuing license signed by the Chairman of the Board.
7-2-6 LICENSE FORM. Attached herein and included as part of this Code is the form of license to be used and issued by the Chairman of the Board.
7-2-7 LICENSE TERM. Upon issuance the license shall be valid for one (1) year and the license may be renewed by reapplication each year thereafter upon investigation and acceptance by the Union County Board of Commissioners.
7-2-8 HOURS OF OPERATION. The hours with which the dance hall or road house may be opened to the public shall be 12:00 P.M. (noon) to 1:00 A.M.
7-2-9 PROHIBITED ACTIONS.
(A) No known prostitute, procurer of prostitution, vagrant, or intoxicated person shall be allowed to be present on or within the premises of a dance hall or road house.
(B) In order to promote good order and morals, it is prohibited for any employee or patron of a dance hall or road house to be engaged in any lewd or lascivious act or to be unclothed in a way known as topless, bottomless or both while the facility is in operation.
(C) No one under the age of twenty-one (21) will be allowed on or without the premises while alcohol is present, unless accompanying by a parent, legal guardian, or proper adult escort. Otherwise, no one under the age of sixteen (16) shall be allowed on or within the premises, unless accompanied by a parent, legal guardian, or proper adult escort.
(D) Noise levels shall be such as to unreasonably and needlessly disturb any of the neighboring residences to the dance hall or road house.
7-2-10 OTHER CODES, LAWS AND ORDINANCES. Before any license may be issued under this Code the applicant must show compliance with all state and local health, fire, building, and safety codes, laws, or ordinances in effect at the time of licensure and upon each renewal. Should the license holder be found in noncompliance at a later date after the issuance of the Dance Hall/Road House License the license shall be invalid until such time the license holder is back in compliance with all state and local health, fire, building, and safety codes, laws, or ordinances.
7-2-11 PENALTIES. A violation of any part of this Code not specifically set forth in the enabling statute found at 55 ILCS 5/5-10001 et seq. shall pursuant to 55 ILCS 5/5-1113 be punishable by a fine not to exceed One Thousand Dollars ($1,000.00), for each violation being a separate and distinct offense subjecting the violator to separate and distinct penalties as well as constituting grounds for the revocation of the license granted hereunder.
7-2-12 EXCEPTIONS. Any establishment that would be required to be licensed under this Codee, but which has obtained a valid license under the Union County, Illinois, Liquor Control Code shall not be subject to the license requirements in this Code.
